Legal Question in Criminal Law in Michigan

We were told that HYTA cannot be used for a crime of CSC 3rd degree. Everything I read on the internet seems to be against what this lawyer has told us. Are you disqualified from HYDA simply because of the csc 3rd degree charge?

Per MCL 762.11 (which you can access at www.michiganlegislature.org), HYTA is not allowed for "life" felonies; major controlled substance offenses; traffic offenses; violation of, attempted violations of, or conspiracies to violate MCL 750.520b, 520c, 520d, 520e.
CSC 3rd is MCL 750.520d. So, it looks like you canNOT get HYTA for CSC 3rd.

HYTA is not an option for a conviction for CSC 3rd degree.
