Legal Question in Criminal Law in Michigan

improper distribution of restitution paid to court

Do I have any recourse when a state office (probation dept.) violates 6 court orders as to the distribution of funds being paid toward restitution for an arson conviction?

Improper distribution of restitution

I should think that a motion to show cause why the probation officer should not be held in contempt would be the way to go. Check with the attorney who represented you in the case and, if he doesn't do civil work, ask him to refer you to an attorney familiar with contempt actions.

Improper Distribution of Funds

You might be able to obtain a "Writ of Mandamus" to force the probation department to distribute thefunds correctly. See your attorney who handled the original case.
