Judge denied reassignment of PD pending psych exam

My fiance was arrested on 10/02/08, arraigned on 10/03/08. At his scheduled prelim hearing on 11/13/08, his PD recused himself, siting a breakdown of communication. The prosecutor then requested a forensic psych exam. Now the judge has denied reassignment of a new PD pending the results of the mental eval, which still has not been scheduled yet. Isn't it my fiance's constitutional right to be represented by counsel for ALL criminal proceedings? What happens if my fiance chooses to NOT cooperate with the mental eval if he is still not represented by counsel?

If your boyfriend has chosen to settle for a court appointed lawyer, he should fully cooperate with his lawyer. He also has the right to hire his own attorney.
