You're allowed to expunge your conviction so long as you meet certain requirements. (1) it has to be a 'qualified conviction'; (2) it has been more than 5 years old (3) you do not have any other misdemeanor or felony convictions on your record. You can read Michigan's expunction statute (MCL 780.621) on line. Go to www.michiganlegislature.org. Then, in the box that says "MCL Section", add 780.621 and hit Enter.

This is one of 5 statutes related to the process, and you're only looking at the first one of them. To see them all, click on the blue hyperlink on the left side of the screen that says "Act 213 of 1965". There you will see all of the expunction statutes, and can read through them.

Another small resource is our office's Legal Definitions page ... go to http://www.eatoncounty.org/Departments/ProsecutingAttorney/Define.htm and scroll down to the "E"s to read a little about expungments.

This is a process where it is worthwile to hire an attorney to make sure you are eligible to apply for this grace, and then to file the best supporting documents and make the best argument to the court to help your case.

If you are not eligible under today's law because, for example, you have more than one conviction, the state legislature has a bill pending right now to relax those rules. It has not been made into law. But you might want to contact your state Rep in Lansing and voice your opinion/support on the matter.

Best of luck.
