Legal Question in Criminal Law in Michigan

Juvenile sexual misconduct

A 15 yr old family member has been placed in my

custody due to problems in both homelife, and poor

choices of his own. He is already on probation

from stealing from a retail store. With court

costs, fines, and rules about going to school,

getting professional help, and staying out of

trouble. He makes poor choices.

Last week he and some friends skipped school 6

boys and 1 girl, got an adult (for no better word)

to buy liquor for them and went to one of the boys

houses. There they started drinking, 2 ended up at hospital for alcohol poisoning, 2 of the boys ages 15 ended up having sex

with the young lady age 14. She is now saying that

she was raped. Today my charge was given a

polygraph and failed. They have said he will be

charged with criminal sexual misconduct. What are his rights, what should we do. I am at a loss.

Thank you for any advice you may have.

Re: Juvenile sexual misconduct

First of all make sure he doesn't make a statement about the incident to anyone. You should contact an attorney immediately for possible representation of your ward. If you can't afford to retain an attorney you should contact the juvenile court and request a court appointed attorney for your ward. If you have further questions or need a referral in your area contact me.
