Is it legal for an 18 year old student to have sexual conduct with a teacher in the same school building that is not her current teacher? What are the consequences?

The student wouldn't be the one in potential trouble with the law. It's the teacher who is at risk in cases like these. But the CSC laws against teacher-student sexual misconduct address students who are 16 or 17 years old (at least 16 but less than 18 years of age). If the student was 16 or 17, the teacher, substitute teacher, or administrator has to work for the school, school district or intermediate school district where the victim was enrolled, ... or the defendant has to be an employee of, contract service provider of, non-student volunteer of, or government employee assigned to provide services to the school, school district or intermediate school district where the victim was enrolled. If the student is a special education student, then the age factor changes to students who are at least 16 but less than 26 years of age,
