Letter of discovery

I understand that as a defendant in a retail theft case, I have the right to view evidence being used to prosecute me. I need to know how to write a letter asking the judge to grant an order of discovery? ... or whatever I need to do to get the procecution and/or retail store to release the video tapes, witness statements and all other items that would help me in my defense.

By the way, I have never stepped foot in the store that has accused me of theft which is why I want to review the tape and ultimately bring a suite against those who arrested and are wrongly procecuting me.

It sounds as though you are foolish enough to try to represent yourself in this serious case. Don't make that terrible mistake. Hire a competent lawyer.

Show up for your pre-trial and ask the prosecuting attorney to review the police report. The tape may not be immediately available, but usually the prosecutor will inform you how to get it.

The judge will adjourn your case to give you time (usually 2-3) weeks to review.
