Legal Question in Criminal Law in Michigan
I live in Michigan and when I was 9 till 12 years old I was sexually molested by my sister, there was penitration..I am now 54 years old.....also my son was sexually molested from the age of 12 to 15 by my sisters son...there was penitration also...witnesses also....The reason for the delay in action is my mother pleaded with me to never say a word until my father passed away as it would kill him to know this information....My father passed on in Jan....and now I feel my sister and her son should pay for what they did to us....it affected my son extremely as he was mentally ill at the time and still is....and it affected me in due to the fact I didn't want to be touched for a very long time by anyone...it still affects me...memories and dreams are expecially hard for me

It is too late for your victimization to be prosecuted. The CSC statute of limitations (deadline for filing criminal charges) in this kind of case is 6 years after the crime date or 6 years after the victim turns 21, whichever is later. So, that deadline passed by decades ago (and the statute of limitations back then may have actually just been "6 yrs after the crime date"). As for your son's victimzation, the same things applies. So, if he is currently 27 years old or older, it is too late to file criminal charges. That said, I feel terribly for what you and your family have endured. Sexual victimization causes emotional injuries that are usually worse than broken bones. Children may not even understand that they were being victimized (they don't know that it is not allowed, not normal, etc.). And, in too many cases, these victims reinact with others what they endured themselves ... so the baton is passed to another generation. And, as you noted, it also affects how they interact in later relationships. Trust once broken is hard to mend. If you have not done so yet, talk to counselors or therapists, please. They can help you heal.
