Legal Question in Criminal Law in Michigan

malicious destructio of property

I was recently shopping and spilled some coffee on a pair of pants I intended to buy. I put them back and picked up another pair and paid for them. Store security has now charged me with retail fraud ( 3rd) degree and malicious destruction of property. I offered to pay for the first pair also and was denied. Is this for real I could go to jail for spilling some coffee an a pair of pants!? I am in michigan

This does not sound like a good case for the prosecution, if everything you state is accurate. However, if they wish to proceed, you will need representation and I strongly advise you to seek an experienced criminal law attorney, such as myself, to handle your case.

You either put something in your narrative that doesn't belong or left out something that does.
