Marijuana possession ticket

A couple of days ago I was ticketed for having 1 gram of marijuana on me. I have absolutely nothing on my record this is my first offense. What can I expect when I go to Court and what should I tell the judge or prosecutor when i get called to explain a my case. Do I need a lawyer?

You are charged with a drug crime which could remain on your record for the rest of your life. It could also cause your driver's license to be suspended. Certainly having an experienced attorney is in your best interest.

It's a 93 day misdemeanor with a mandatory 6 month suspension of your driver's license (It doesn't matter if you didn't get got caught in your car.)

You won't go to jail and will get probation and the license suspension if you plead guilty when you first go to court. But if you plead not guilty and get a second court appearance (a pretrial) you will have the opportunity to keep the conviction off your record and avoid the license sanction.

This is usually accomplished by requesting that your charge be taken under section 7411 of the public health code.

It would be a good idea to stop smoking marijuana immediately as one dirty urine sample will violate your probation.

If you can't afford an attorney, you can ask for a court appointed lawyer at your arraignment. If you're smart enough to follow the above instructions, you may not need one.

Remember, one conviction for possession that stays on your record can cause you a lot of grief (beside the license penalty) in getting a job or applying for a student loan.
