Marijuana possession

19 yr son received 2 possession tickets within one month with order to appear in 2 different district courts. These are his first (and second) offenses.

The first was a raid on a home and all present were given possession tickets, however he did not have anything on his person. The second was a motor vehicle pull over for broken headlite and he agreed to

search, found small amount. Advice please - he is currently in outpatient drug rehab (started after this). Do we need an attorney?

Your approach to these two charges of possession should be one that results in no criminal record being generated. If one is, your son's driver's license can be suspended (and your or your son's auto insurance rates will increase). Also he may be denied elligibility for student loans if he chooses to go to college.

An attorney can determine the best way to defend against these charges. Records of his attendance and progress in rehab should be kept. The court may be supervise him in the future by conducting periodic urine drops. Be aware that THC (the active ingredient in marijuana) stays in the body's fatty tissues for 30-40 days after the last contact.
