Legal Question in Criminal Law in Michigan
Minor arrests
My friend had to go to court for skipping school, but he missed his court date. They put a warrant out for his arrest and assigned him another court date. He went to his next one, but they put him in a detention center for 5 days, until his next court appearance. A week from his next court appearance he will be 18, legaly able to drop out of school. Is it possible that they could still charge him, or keep him in jail past his 18th birthday??? His only crimes are m,issing a court apperance and skipping school.

I have a few problems with your post. First of all, a person can stop attending school after age 16 in Michigan. In Michigan a 17 year old is considered an adult as to the commission of crimes. Therefore, your friend was either under the continuing jurisdiction of the juvenile court for another matter and as such as a condition of probation was ordered to attend school. Failure to attend school as a condition of probation would result in a probation violation and subject your friend to incarceration. A judge can order a probationer to attend school until a degree is received or a GED is obtained. failure to do so may result in incarceration. Your friend should contact an attorney to fully explore his options.
