If this is your first MIP (and have no Open Intoxicants in a Motor Vehicle tickets either), jail is not part of the penalty. The maximum fine is $100, not including court costs, and community service is a possibility. This will also go your driving record and your insurance rates will probably go up. Also, keep in mind that if you are in high school sports you may very well be suspended from the team for a while too....
If you have prior MIP's or Open Intoxicants in a Motor Vehicle tickets, thats where probation and jail may come into play and you WILL lose your drivers license for a period of time.
