MIP 2nd Offense

My son received a 2nd offense MIP. Received 4 months probation, community service, fines & driver license sanction. At 4th month probation meeting was urine tested and was positive. We had a blood drug screen done, by family doctor, which came back negitive. Can he go to jail for the failed urine test with a negitive blood test that was dine within 36 hours of each other?

I'm sorry that your son is now stuck with a criminal record for the rest of his life. That's a bad result for a young kid.

The judge would make a determination about which test was most valid for drug use. An experienced and aggressive attorney might be helpful to your son.

Tested positive for what? They don't do urine tests for alcohol If it was for cocaine or opiates, the later drug test is suspect and not of much use.

If it was for THC (marijuana) the later test would be helpful at a VOP hearing.
