Legal Question in Criminal Law in Michigan

My 19 year old son lives with three other boys in a leased rental house in a college town. They recently had people over for a party. People brought people and soon there were kids there from 15-19 years old. One by one , they all left. The four tenants went to bed upstairs. Some of the minors returned to the house unknown to the sleeping tenants upstairs. The police knocked on the door, one of the minors opened the door , and everyone was rounded up. My son and the tenants were awoken and brought in for questioning, given a breathalyzer, and then jailed and given MIP tickets and released 8 hours later. they each had to post $100 , 10% of a $1000 bond. They all have a court date in two weeks for the MIP charges. Why the jail time and bond for MIP ; could they be charged with further offenses at the court date and what might they be?

If you decide to fight this charge aggressively, it might be able to be dismissed entirely based on Fourth Amendment issues. The fight could cost a couple of thousand dollars, but might be worth it to keep your son off probation, etc.

Minors charged with possession of alcohol don't get taken to jail absent other offensive behavior (like contributing to the delinquency of other minors, disturbing the peace, resisting arrest, disorderly person).. First conviction of MIP carries no jail time by statute; only a $100 fine.

One fact seems clear - your son had been drinking in violation of Michigan law. If he pleads under the MIP statute and stays out of trouble for a year, (abstinence from alcohol required) there will be no record of this offense.
