Legal Question in Criminal Law in Michigan
Miranda rights.
My daughter was arrested for shoplifting and was not read her rights before she was questioned and taken to the police station. Can I get her case thrown out of court? She just turned eightteen one month ago. Thank you.

Re: Miranda rights.
Miranda warnings only apply to custodial interrogations by police officers. Her statements were liklely given to loss prevention agents, not police officers, so no it won't be thrown out. However, your daughter may be eligible for programs that allow her to do a term of probation without having a conviction on her record. You should hire an attorney.
