Legal Question in Criminal Law in Michigan

Misdemeanor

I'm 19 yrs. I received an MIP. I took a

breathalyzer test. I'm not sure what I

should plead in court considering its my

first offense. How do I get it off of my

record without a lawyer?

Re: Misdemeanor

Ask whomever you next contact in the court (prosecutor, magistrate or judge)if you can plead guilty without having the MIP on your record.

If the answer is no (It won't be) ask for a court appointed lawyer.

Re: Misdemeanor

Your question is silly.

If you needed surgery, would you put a post on the web asking how to do surgery without a doctor?

Do you feel more qualified to practice law than to practice surgery?

Re: Misdemeanor

A portion of the MIP statute gives the court the authority to place a "true first offender" (no priors) on a probation/diversion where the charge can be dismissed at the end of a successful probation period. You do not need a defense attorney to get this ... but having a defense attorney (hired or court-appointed) may still help because that attorney will know your judge's tendencies, etc.
