Legal Question in Criminal Law in Michigan

Moving out

My boyfriend and I got in to trouble with the cops about dating--name removed--minor when i was younger. Nothing went on our files about it but can I(17 years old) move in with him(21 years old) and not get in trouble with the cops with out parent permission?

Re: Moving out

You are not legally emancipated until you (a) turn 18, (b) marry with your parents' permission, or (c) have a judge proclaim you emancipated after you have filed a petition for emancipation and meet the requirements [including that you are financially independent and can support yourself] for emancipation. Until then, you are still your parents' child, and must abide by your parents reasonable orders. You are not old enough to sign contracts that bind you legally (like a rental agreement with an apartment), so you really are dependent upon an adult for your pasic needs, like 'shelter'.

Will you get "in trouble" if you disobey your parents in this regard (moving in with your 21 year old boyfriend)? There is no definite, legal answer. You are not committing a "crime". but, your parents could take some action by filing a petition with the family court that you are "incorrigible". Not many parents go that far. It's a civil case asking that the family court take jurisdiction of you to protect you (from your own actions or the actions of someone else).

Moving out

No. Even with permission, stay away from the pedophile.

Re: Moving out

Your parents have legal custody of you until you turn 18. It's up to them to exercise it.

Your boyfriend won't go to jail unless there is PPO or other injunctive order in effect.
