Legal Question in Criminal Law in Michigan
My nephew was sentenced to 120 day at a rehab center in Michigan. He was kicked out yesterday after 93 days for being in a friends room. He doesn't want a warrent sent out for his arrest, can he just go into court and ask to speak to the judge?
1 Answer from Attorneys
There is certainly more information needed to fully answer this question. If the rehab was a term of probation, then he needs to contact his probation officer if he has not already done that. He could be brought before the Judge on a probation violation and sentenced to jail or prison. Likewise, I would need to know whether a felony or misdemeanor, and before which judge to fully answer the question. However, the simple answer is yes, contact his probation officer or the court to schedule a time to appear before the court to explain why rehab was not successfully completed.
