Legal Question in Criminal Law in Michigan
Noise Violation as Violating Probation?
I am on probation with a deferred conviction for possession of marijuana. The term is one year. I recently recieved a noise violation and was told that it was a misdeamenor. Does this ticket violate my probation? One of the terms is that I do not violate any criminal law. I know traffic tickets are excepted. Please let me know about the noise violation.

Re: Noise Violation as Violating Probation?
Technically, it is a probation violation. Your probation officer has the discretion not to issue the violation if it is relatively harmless and the judge has the discretion not to revoke your status.
But, if the circumstances of the "noise violation" involve other issues (e.g. alcohol), you may have your deferred status revoked.
