Legal Question in Criminal Law in Michigan

obtaining a video tape from a patrol stop

I was just wondering how i can file a motion to discover the video tape during a defaluty equipment traffic stop? The traffic stop resulted in my car being search and sezied for marjuana. I posted a bond to go to a civil court trail to recieve my car back and i won the civil case. I have my car back and got it back for completely free. I didnt even have to pay towing or anything, because their was know poof i was trafficing. I do not believe that my lisence plate light was burned out and if it was this tape should clearly show that. I need to know if that light was or not for the criminal case and the police officer really has it out for me and knows a description of my vehecle prior to being stoped. how do i go about obbtaining this tape? Are there anyway for me to veiw an example of a motion to discover from a simliar case? and if so where?

Re: obtaining a video tape from a patrol stop

It's unlikely that there is a video of the stop. If there is, you can request a copy at your pretrial. The police report will indicate whether a video ws taken.

OR YOU CAN

1.Turn your headlights on.

2. Go to the back of the car.

3. Look carefully at the lights.

4. Are any of them burned out?

5. Repeat as necessary.
