Legal Question in Criminal Law in Michigan
Odds of a conviction
I am currently being charged with malicious destruction of property and assult and or battery. The victim called my home and harrassed me, my son had just passed away and I was a wreck. She called my home and said ''It would have been funny if I had showed up at the funeral, What did you do to kill your son because a four year old not just going to die,and she told me to get my daughter out of the house if i don't want her to get hurt.I got in my car and went to where she was and i broke her window of her car and her tail light, I had mace in my hand but did not use it. She hit me with a glass bottle. SHe has no witnesses it is my word against hers. In the police report she got her time wrong so i have four witnesses that can say I was at home at that time. I also have about 7 character witness that can say that the girl is disturbed.Can I plead not guilty due to temporary insanity, or will i still be held accountable for my actions? I really want to plead not guilty and got to trialbut what are the odds of the jury believing me over her?
