Legal Question in Criminal Law in Michigan
Open beer on passenger
I was pulled over this past weekend and the passenger had an open beer in the car. I received a ticket. The passenger also had drugs on him and was charged w/that (the passenger). Is there any way I can fight this? I was aware the beer was in the car, but not that the passenger had opened it. I don't think the passenger will attend court either. I have no priors.

Re: Open beer on passenger
It's illegal to knowingly have open intoxicants in your vehicle. If you didn't know the beer was open, then you aren't guilty. Set the matter for trial.
