Legal Question in Criminal Law in Michigan

P.A. Diversion

I am accused of 3 felonies and am in the state of Michigan.(Count 1) Larceny in a building.(Count 2) Controlled substance narcotic/cocaine less than 25 grams.(Count 3) Interfering with electronic communications. The evidence they have is a witness who has prior possession felionies, and was declared not mentaly fit to keep working as a P.A. (Physician Assistant) by a psyc eval. I've had two settelment conferences, at first they offered me the H.Y.T.A if I pled guilty to counts 1 & 3, they offered this plea twice. Now I am 5 weeks from trial, they last offered a ''p.a. diversion'', i would have to pay a fee, do community service, and counciling ''if avalable''. Now my attorney told me that the case would be dissmissed if I took this plea, and the record would be sealed. my questions are #1, what percentage of being found innocent do I have with the lack of evidence they have. #2 What is a ''p.a. diversion''? #3 If I take any plea bargan aren't I pleading guilty to something? #4 A sealed record isn't expunged so it's is still veiwable right? To add on to the evidence, when I was arrested there was nothing found on me, and no other search was made, and I was never drug tested. the phone was in my name,and was not taken from person. ty

Your questions need to be directed to YOUR ATTORNEY since she/he if much more familiar with the particulars of your case. If you do not trust the lawyer you hired, hire a different lawyer.
