Police officer's failure to inform/serve defendant of civil infraction complaint
If a police officer fails to inform a minor of his/her right to refuse a breathalyzer test and also fails to check the coinciding box which reads: ''I served a copy of the civil infraction complaint upon the defendant (or owner/occupant if applicable)'' is it grounds for dismissal of a minor in posession of alcohol charge?
