Legal Question in Criminal Law in Michigan
possesion charge
I was charged with possesion of a small amount of marijuuana. But while being arrested i was never told why i was pulled over and the cops never read me my rights. Do i have any chance of beating the case?

Re: possesion charge
The law does not require police to tell you why they pulled you over.
Also, the law does not require police to read you your Miranda rights UNLESS they want to question you about a crime after you have been placed in custody (e.g., you are arrested or otherwise reasonably believe that you are not free to go on your way). If you are arrested and they don't question you after the arrest, then Miranda rights are irrelevant. Further, if they arrest you and you just start blabbing about the crime without police asking you about it, then the rights are irrelevant.

you may have good search and seizure issues at stake. If the matter is in SEMichigan, contact me at www.kliszlaw.com to discuss in details. Tim Klisz

Without knowing all the facts and reviewing all of the reports it is impossible to tell you your chances. With that being said, the police must have reasonable suspicion to pull you over. I would be glad to talk with you further if you'd like. Please call us anytime toll free at 877 MICH-TEAM.
