Legal Question in Criminal Law in Michigan

Possession of a controlled substance

I am currently on probation for DUI #3. Police were called for a noise complaint (b/c of an argument with girlfriend). She put my things out which included a prescription for ambien belonging to my father. I was charged with poss. of a ctrlled substance. Can I fight this? Will I violate my probation and go to jail? If found guilty, what are some possible repercussions?

Sure you can fight it - just understand that the burden of proof is much lower for a probation violation. A typical defendant's chances of beating a charge like yours is pretty slim. If you originally pled to a 5 year felony (OWI-3x/10 years), you're looking at jail or prison time on your VOP.

Before you contact a lawyer, make a decision. Do you want to continue to be arrested for the consequences of using drugs and alcohol, or do you want to get clean and sober?

You're really dealing with probation - the court gives great weight to its recommendations. If probation can't see a turnaround in your behavior (e.g. Rehab,AA,NA), expect an unhappy result.

If you won't clean up, you're wasting a lawyer's time. I will not represent active drunks and drug addicts.
