Possession of marijuana
My friend's 18 yr.old daughter was arrested for possession of 2 to 3 grams of marijuana a month ago. This is her first offense. She was a passenger in a vehicle that was pulled over due to a license plate light that was burnt out even though lights to the vehicle weren't on because it was still daylight. The arresting officer searched the vehicle on suspicion that he could smell marijuana. The driver was also arrested for 2 roaches in his cigarette pack. My friend's daughter was arrested before it was known she was holding marijuana. Two other passengers, one 16 and one 18 yrs.old, were given tickets and one passenger was allowed to leave by the arresting officer. At this time she doesn't know what she's being charged for, and she hasn't been given any information as she's been told there is an open investigation.
Was it legal for the officer to arrest her on suspicion? At the time of a hearing should she plead guilty or not guilty?
Also, when the officer had the driver pull over it was near school property but after hours at the time of arrest. On her document the officer listed the name of the school as the address. However, on the two who were given tickets it was written up as a street address.

Your friend's daughter told your friend about this who, in turn , told you. This is called double hearsay in a court of law because the testimony is deemed unreliable.
In addition, teenagers arrested on drug charges seldom are candid with their parents who may not be candid about their child' behavior to others, i.e. you.
