Legal Question in Criminal Law in Michigan
possession of marijuana
about three months ago i was driving with my friends in my truck and was pulled over for my taillight. they took everyone out of my truck and searched us and then searched my truck and found about 2 grams of marijuana. the officer had us behind the car for a while while he looked through my truck. then, after taking our information he told us to go sit back in the truck. he came up to the truck and said he was letting me off with a dismissable taillight ticket. he never mentioned anything about the marijuana. a few days ago...which is about three months from the incident... i recieved a letter in the mail to appear in court on possession of marijuana charges. i was wondering if there was anything wrong with what he did...because he never gave me a ticket or notice that i was getting charged.

The officer may have violated your rights, but not because of the delay in receiving the ticket or because of his failure to tell you that you would be charged. You should hire an atorney and ask him to get a copy of the police report. An experienced criminal defense lawyer will know what to do.
