Legal Question in Criminal Law in Michigan

possession of marijuana

the police knocked on my door looking for someone that does not live at my house. my husband and i were smoking a joint we gave them the pot, and signed a consent to seach. they did not write us a ticket, or take either one of us to jail, and 10 days later we were sent a letter to appear for arrainment. is this right?

Right or wrong, it sounds to be as though it was a legal search, especially since you gave them express consent to search your house. (In the future, don't do that.) However, maybe there is something you're not explaining which might be able to negate the legality of the search. Call an attorney as soon as possible to represent you in this matter!

Depends on what you mean by "right." If you are asking if what the police did was legal? The answer is yes - according to the facts as you have laid out. In your posting you stated that the police knocked on your door looking for someone. That you gave permission for the police to search your house. That at the time of the search your husband and you were smoking pot. That you handed the pot over to the officers. That they left without arresting you and sent you a notice to appear for arraignment. You are probably being charged with either use or possession of marijuana. Depending on where you live you could also be facing charges of operating a drug hopuse or violation of a drug free school zone. Cities and counties differ on how they overcharge defendants.
