Possession of narcotics
My husband was arrested last Friday for open intoxicants and possession of cocaine. It was his car, but he did't posses anything, the passenger did. He was aware of the beer, but not that the passenger had opened it. He was NOT aware at all that the passenger had narcotics on him. He was pulled over in the bordering suburb because the suburban cop said it looked like my husband did a ''drug deal'' at a gas station in Detroit. My husband told him he was talking to the man about his system in his car(my husband loves/has loud music systems). Nothing was found on my husband, he has no criminal record, but they found cocaine on the passenger and the open beer, so they were both arrested. The passenger already is on probation for the same thing a yr prior. I've looke up ''constructive possession'' and that doesn't even apply to my husband. The passenger even said he didn't know. We also believe the passenger won't show up to court next Monday due to his prior history. What should we do, do you think the judge will dismiss the charges. Also, would it help if we're able to get the passenger to write a ltr stating my husband had no knowledge?
