Legal Question in Criminal Law in Michigan
Can prescription medication be refused to inmates?
My minor brother was prescribed an antidepressant by his doctor and was recently sentenced to boot camp for a number of charges, and was scheduled to leave last week, but he's still in jail. According to the police to go into boot camp you can't have any drugs in your system for 60 days before going into boot camp, so they have taken away his medication. Can they do this? Isn't denying prescription medication cruel punishment? The police say if we try to fight it he will be re-sentenced, and we're afraid he'll get a worse sentence. It doesn't seem right that we should have to decide between his medication and a worse sentence.

Your brother's lawyer should address the medication issue with the sentencing judge.
