Normally the judge signs an order discharging the defendant from probation.

Re: probation

The "People of the State of Michigan" would not, because that would refer to the Prosecuting Attorney's office. We do not generally keep tabs on every case on probation, and we have no role in deciding when someone's probation is "over".

The court is responsible for monitoring probation for misdemeanor cases and non-prison felony cases. The Michigan Department of Corrections monitors the 'probation' end of prison commitments (called "parole"). Those departments, and/or the judge assigned to the case, would be responsible for determining when a person's probation/parole status is "over". The judge would have to sign an order discharging a person from probation.

I do not know whether there is an affirmative duty on the departments or the court to tell YOU that your probation is over. To the contrary, you have an affirmative duty in most cases to keep in contact with the probation/parole agent.

Bottom line: if you are in doubt as to whether your probation is still open? Contact your probation/parole officer! Take the initiative. Do not "assume".
