Legal Question in Criminal Law in Michigan
Probation and 74-11
My son has been charged with marijuana possession with intent to deliver (2 ounces). He was already on probation for felonious assault. He maced someone and pled guilty under HYTA. His attorney is asking for 74-11 on the marijuana charge. is that also a probation situation? What happens to his HYTA status?

Your son can't get 7411 for possesion with intent to deliver. 7411 is for possession only. Your attorney should know this.
The sentencing judge has the discretion to revoke his HYTA when he next appears for his probation violation.
