Legal Question in Criminal Law in Michigan

Prosecutor misconduct

I am charged with 4th degree CSC.My prosecutor has a long personal and ongoing relationship with the ''alleged'' victim and her family. I am confident of acquittal. I plan on filing a complaint against the prosecutor with the the Michigan Bar Association after the trial. I am not going to force a recussal because we plan on using the relationship in our defense. Despite the statements of 19 on-the-scene witnesses, the trial proceeds at considerable expense and hardship to me. At the preliminary hearing, the ''alleged'' victim bombed on the witness stand. She mis-identified witnesses, mis-identified clothes the ''attacker' was wearing versus what I was wearing (I have photographs of what I was wearing) and much much more.

The prosecutor refuses to investigate the matter in a complete professional manner and is using the trial as a campaign issue for his 2008 re-election.

I would like to get your thoughts on what I have described.

Re: Prosecutor misconduct

You should probably talk to your lawyer regarding those issues. I would have to know much more about the case to be able to give you thoughts on it.
