Legal Question in Criminal Law in Michigan

public defenders

Is there anything that can be done when a public defender is incompetent? He has been given hundreds of pages of information, but hasn't gone over any of them with the accused, even to the point of just suggesting plea bargain, when the accused feels totally innocent. 7 months and only 1 visitation with public defender... attrocious. If he had money, he'd be hiring someone to defend him properly! Apparently, he cannot ask a judge to get another lawyer, because the public defender would be doing the asking? This is a poor example of justice...

Re: public defenders

This is a very common story about court appointed lawyers. Maybe family members will be willing to help out financially to hire a tough lawyer to fight this battle.

Re: public defenders

Public defenders are paid a flat fee for his defense. Michigan public defenders are among the lowest paid lawyers in the USA.

"Hundreds of pages" without any specific reason for the information (i.e. What would they prove?) cannot be used in his defense.

He can always ask for another court-appointed lawyer. Usually the judge will grant the request if there's a good reason for it.
