Legal Question in Criminal Law in Michigan

question on supeona

If you live in TX and Michigan wants to supeona you back to MI to testify in a Murder trial, will this go through the court system in Tx? I was told it would not go by way of Sheriff's dept in Tx. Should there be a record of it at the court house in the county in TX ? Would the supeona be signed by the TX judge? Could you please explain this process?

If you are in custody, your transport would be procured through a writ of habeas corpus rather than a subpoena. If you are not in custody, the out of state subpoena (if it is from the state rather than the federal authorities) would be re-routed the local courts. There may, however, be no official record kept of such a routine proceeding as a subpoena, which is an ex parte proceeding.
