Legal Question in Criminal Law in Michigan

I have two questions:

1 i was convicted of 333.74012C-A Controlled substance - delivery/manufacture (schedule 4). in 1993 i cant figure out if that was a felony or a misdemeanor. ICHAT shows it as a Misdemeanor.

2. since i have not committed any crimes since then can I get it expunged?

Delivering/Manufacturing should be a felony unless it was pled down to something lesser. If that is the only conviction you have, you should be eligible for an expungement provided it has been at least five years since your discharged form probation/parole or release from incarceration, whichever occurred last. If you have any "convictions" that were deferred under special sentencing diversions like 7411 or HYTA those count as convictions for purposes of expungement eligibility. You can get a felony expunged if that particular felony is eligible for expungement and you have no more than two misdemeanor convictions. You can get up to two misdemeanors expunged provided they are eligible misdemeanors and you have no more than two misdemeanors and no felonies.

Feel free to give us a call and discuss your eligibility and how we can help. Your first consultation is always free and with no obligation. We can be reached directly at (517) 614-1983.
