Legal Question in Criminal Law in Michigan
Three Questions: (1.) Can law enforcement in Michigan stop a vehicle with out a reason?? I was at a stop light heading East, The officer was tarveling South and made a right turn heading West. The light turned green and I proceeded East. The Officer made a U turn and pulled me over. I was ticketed for driving with a suspended license and for expired license plates. The Officers Written Police report says that he was following me and ran my plates and discovered that the plates were expired. (not true he was only following me after he turned his lights on and had already made the decision to pull me over) If I plead "not gulity" and the officer is on the stand, under oath, can he change his story (police report) and say he stopped me for a different reason. My hope is the court will not allow him to change his story to justify his stopping me. It would seem that Police Officers in Michigan or any State for that matter, can not just arbitrarily stop any one, and it would not be reasonable to believe that this officer runs every license plate that he sees every day while on patrol. With the above information do you see any defense that would question the arresting officers procedure that would get the charges dismissed??

You might have some defenses available to you. However, it is necessary to have much more information in order to have an attorney give you a valid legal opinion. However, you certainly should have an attorney assisting you.
