Receiving and Admitting for and Immoral Act

The charge resulted from a police sting where I was observed picking up a prostitute. As soon as this girl entered my vehicle I knew I wanted her out. I pulled over into an alley where she said to. I told her to leave my vehicle without having any sexual contact with her. I had to pay her to get out. My belt was unbuckled; that was it.

The police stopped me immediately. During interrogation just before they stopped I said ''I knew it was wrong''. The Officer said, what was wrong? I said ''The whole situation, look what happened''.

The prosecution has not produced the girl in several court appearances. The Officer is there each time. Yesterday they offered disorderly conduct. We rejected it and requested a jury trial.

What is the penalty for each offense? The trial is set four months from now. I do not like having this unresolved. What is the best course of action at this point? Do I accept the disorderly if it is offered again before trial? If so, can the judge decide to have it removed after 3 or 6 months? Can I be convicted based on the officers testimony?

I am assuming that this is at 36th District Court. If the "witness" does not show up to testify on the trial date, your case should be dismissed. If it is a bench trial and the witness does appear, chances are great that you could still take the lesser plea. You have a lawyer. Why aren't you asking him or her?
