Legal Question in Criminal Law in Michigan

Record cleared

I desperately want to join the United States Army. I made one mistake twelve and half years ago (12 1/2) when I was arrested for Attempted Possession on Narcotics. I have not been in trouble ever since. I thought and believed that if I stayed out of trouble and did the one year probation they offered me that it would not be held against me. I was wrong. I never did a day of jail time and I never got into trouble while serving my probation. I have a clean driving record and I have never had a problem with drugs.

After applying for a job I learned that I had a criminal record on file. Not familiar with the law I thought if I got the case esponged, my record would be clear and I would be able to join the Army. Instead, every time the Army did a security clearance that one case comes up.

What can I do? How can I get this one blemish off my record? Is there any way you can help me? I would do anything and submit to any test to join the armed services. All I'm trying to do is better my life and for me and my family.

Please, if possible, would you help me or direct me to someone who may can help. I have regretted that poor choice of judgment I made every since

Re: Record cleared

I'm surprised your case was not taken under .7411, which allows for a dismissal of the charges once you complete probation. Did this occur? Did you violate probation? If not, is the Army telling you even an arrest without a conviction will not allow you in? Your last step would be to set aside the conviction at the court who sentenced you. You need my help with this and I would be happy to speak to you about the matter. Visit www.kliszlaw.com to discuss. Tim Klisz
