Legal Question in Criminal Law in Michigan
can you refuse probation by maxing out your sentence on the original charge in which youre on probation for in this case i stole a 7 dollar bag of tabacco and was sentenced to three years probation I violated and now I dont want to go back on probation the max sentence is 93 days on the retail fraud is that the most I can do and can I say I dont want to do the probation just give me the jail time

Jails are crowded and jail time costs the county $$$.Jailors are supposed to pay rent (about $65/day) upon release but seldom do, so the taxpayer gets stuck paying your room and board.
You must have made quite an impression on the judge to get 3 years probation.
