Legal Question in Criminal Law in Michigan
She doesn't remember
my neice reported she was raped,she went to a hospital , they had been drinking, now she says she don't remember what happened and doesn't want to testify, she is scared beyond all reasoning, the da. has threatened her with jail, under washinton vs crawford it states that the accuser has the right to say she didn't give statement thinking it would go to trial, can she use this, is there a way for her to get out of it or should she see an attorney ?

Anyone that is being threatened with prosecution should be consulting with an experienced and aggressive attorney.
