Legal Question in Criminal Law in Michigan

retail fraud gas station

In desperation last year when he was out of work my adult son took off after filling his gas tank because he did not have the money to pay. This week he was stopped by the police and was arrested and let out on bond for retail thief. Will he be going to jail? He is low income with a wife and 3 children he can not afford to pay up front and is afraid he will lose his job. A court hearing is schedule for next week.

Your son's "desperation" is no excuse or defense to stealing.

His charge will probably be Retail Fraud 3rd Degree (or 2nd Degree if he has a prior theft conviction). Both are misdemeanors. However, for either one, there is a penalty "advisory" that adds a driver's license suspension under MCL 257.319.

Whether he gets jail is within the judge's discretion. One big factor is the defendant's prior criminal record.
