Legal Question in Criminal Law in Michigan
retail fraud 3rd degree
my son was arrested for stealing a t-shirt worth $28.00. the shirt was returned right away to the store. the dept stores attorney sends a letter stating we owe 10 times the retail price but not more than $200.00. if we do pay they will not take any further civil action against us. Do we owe this?

The civil law states that your son (if he's 18) or you owe the store $200. This won,t have an effect on the criminal charge (I never had a prosecutor mention it.)
If the attorney's letter came from Florida, I doubt that they would sue if you didn't pay. It won't matter to the RF III pending in criminal court.
