i wanted to know at what degree is retail fraud considered a felony?

Retail Fraud 1st Degree is a felony. This requires proof that more than $1,000 in merchandise was stolen (or a price-switch difference) ... OR ... $200 to $999 worth of merchandise was stolen and the defendant has a prior conviction for Retail Fraud 2nd or 1st Degree.

Retail Fraud 2nd Degree is a misdemeanor. Proof requires merchandise worth $200-$999 being stolen (or a price-switch difference) .... OR ... theft under $200 with a prior Retai Fraud conviction.

RF 3rd Degree is a misdemeanor where under $200 is stolen.
