Legal Question in Criminal Law in Michigan

I was caught shoplifting about $35 worth of stuff from Meijer in 4-97 along with 2 other 'friends.' I had completely forgotten about it (the other 2 went to court and got off because one of the guy' dad knew the prosecutor). I was paying a ticket in another county over 5 years later and they almost cuffed me and took me to nearly 60 miles to the other county to sit in jail. I was lucky and told them that I would go in myself and I did, but they told me to come back tomorrow. I am wondering what to expect when I do go back in tomorrow, and should I get a lawyer? Does what happened to the other 2 guys affect me at all (we were all over 18 and I stole the least ammount of stuff, but all were under $200). Also, it seems that they are charging me with retail fraud 2nd degree, can this be dismissed or will I get any jail time? I was convicted on a HYTA on larceny in a building about 2 years prior and satisfied all the requirements for that.

Based on the information you have supplied, your new charge may effect the HYTA conviction and it could be placed on your record and used against you. Yes, you do need a lawyer. You have too much to lose based on all the facts. If you have not hired someone by your first court appearance, ask the prosecutor for an adjournment so that you can obtain an attorney. Also, don't bet on a dismissal. I recently represented a person on an old 1997 case and the store people showed up for the bench trial!
