Legal Question in Criminal Law in Michigan

return of seized property

during the course of a raid, my possesions were all seized. 9 months later, no charges have been filed and my property has not been returned. How long can my property be kept by the seizing agency (Livingston County Sherriff's Dept.)?

Re: return of seized property

It depends on the facts and circumstances of the raid. There is no easy way to ask or answer all the questions that you or I have by email. I suggest that you call me.

Why not call the sheriff and ask him?

Usually nobody gets their property back unless they ask first.

You should know that even if no charges are brought, your "possessions" can be seized.

If they were truly seized (and not just held as evidence), you got a notice of seizure that required a quick response to save your stuff by posting a bond. If you didn't respond, your possessions are history.
