Legal Question in Criminal Law in Michigan
Roommate Party/Underage Drinking
My roommates just informed me that they will be having a party next week. One girl is 21 and the other 3 girls are 20. I know that most of the people there will be underage and drinking. The 21 year old plans on buying alcohol for the minors. I don't plan on going because I don't want to get into any legal trouble with all the minors there. (I am 21). However, if the police did come, and I was not there, could I still be held criminally responsible in any way? Someone told me if my name is on the lease,I would be held responsible, regardless if I am actually there. Is it a huge liability for me to let this party go on? Or should I just leave my apartment that night and not worry about it?

Just leave your apartment that night and don't worry about it! Of course, if your landlord finds out about it, you all conceivably could be evicted i.e., read the part in your lease about unlawful activity..
or
grow a pair and tell your roomy that it ain't gonna happen.

You're not criminally responsible if you have nothing to do with the party. In terms of civil liability, it is possible that you'd get dragged into a civil lawsuit if someone got hurt. It is also possible that you landlord might take some action against you. I'd speak to your friends to suggest that it really isn't worth risking a criminal record for the rest of their lives for a silly party.
