Legal Question in Criminal Law in Michigan

he said/she said felonious assault

Son,23, is in jail charged with felonious assault. He has asked for jury trial. He says he was attacked outside of bar,

had a chair thrown at his face.

That night he sought medical

treatment, also took pictures showing multiple facial inj. He

did not go to police, having a fleeing/eluding charge

at 18 for which he did time and

was released from probation in 5 of 05. Someone did go to the

police, we do not know who, and

stated my son threw a chair at them. Son took jail instead of

bond, has a PD, and has a pretrail next week. With my son's injuries and documentation, do you think the

case may be dismissed, as the

other person was not injured as

much as he was. He cannot get

another felony, should I hire

an attorney? How about a civil

suit against the claimant for

my son's injuries if criminal

case is dismissed or won. Can

my son's prior conviction be

held against him for this?

I need more information in your sons case in order to make a better assessment. First of all, your sons first conviction may not be used against him in a subsequent trial. If can be dismissed if the evidence shows that he was defending himself even though someone had said that he had thrown the chair. Your son's criminal case
